Con-way Freight President David S. Mcclimon to Testify on Reforming Hazmat Trucking Security Legislation Before House Subcommittee

Mr. McClimon will appear on behalf of Con-way and the American Trucking Associations before the Committee to provide testimony related to H.R. 5604, the Safe Truckers Act of 2006, which would reform current laws to introduce a more common sense, risk-based approach to regulation and protection against threats posed by transportation of certain hazardous materials.

Regulations implemented previously by the Transportation Security Administration under the U.S. Patriot Act require commercial drivers to bear the cost of performing a fingerprint-based security threat assessment for those seeking, renewing or transferring a hazardous materials endorsement to their commercial driver’s license, regardless of the type of hazardous material being transported. The requirement applies broadly, not only to truly security-sensitive materials, but also to commonplace, everyday commodities classified as hazardous materials, such as paint, nail polish, perfumes, soft drink concentrates and normal household products such as bleach and detergents. Mr. McClimon will testify to the need for adopting this legislation to distinguish between screening processes for hazmat that pose a true risk to homeland security, and the majority of material that poses no significant security risk.  He also will comment on the need for uniformity of regulation such that provisions for screening for permits to transport high security-sensitive materials are incorporated into existing hazmat background examination programs, rather than simply creating a separate and costly additional program.
